Việt Nam phản đối nhà cầm quyền Việt
Nam
xét xử phi pháp các nhà bất đồng
chính kiến, tranh đấu dân chủ nhân quyền tại
Việt Nam
Trong thời gian kể từ đầu năm 2007 tới
nay, các tổ chức đoàn thể độc lập
tại Việt Nam đă bị nhà cầm quyền cộng
sản Việt Nam đàn áp khốc liệt với mục
đích trù dập, triệt hạ khát vọng tự do
dân chủ của đại đa số nhân dân Việt
Nam. Sau một thời gian hoạt động bị
gián đoạn v́ bị truy bức, đàn áp dữ dội,
nhiều thành viên bị bắt bớ, kết án nặng
nề, nay Uỷ Ban Nhân Quyền Việt Nam tiếp
tục cập nhật t́nh h́nh vi phạm nhân quyền
trầm trọng bởi nhà cầm quyền cộng sản
Việt Nam thời gian qua. Những vụ án xét xử
phi pháp được liệt kê dưới đây:
·
Ngày 30/3/2007 tại Huế,
nhà cầm quyền Việt Nam đă đưa ra toà xét
xử và kết án Linh mục Nguyễn Văn Lư và các cộng
sự của đảng Thăng Tiến Việt Nam:
- Linh mục
Nguyễn Văn Lư, nhà sáng lập và lănh đạo
Khối dân chủ 8406, (bị bắt giữ ngày
18/2/2007) với mức án 8 năm tù ở
và 5 năm quản chế.
- Anh Nguyễn
Phong, trưởng ban thành lập đảng
Thăng Tiến Việt Nam, (bị bắt
giữ ngày 17/2/2007) với mức án
6 năm tù ở và 3 năm quản chế.
- Anh Nguyễn
B́nh Thành, đồng sáng lập viên đảng
Thăng Tiến Việt Nam, (bị bắt
giữ ngày 17/2/2007)
với
mức án 5 năm tù ở và 2 năm quản chế.
- Cô Hoàng
Thị Anh Đào, thư kư đảng Thăng Tiến
Việt Nam, (bị bắt giữ ngày 19/2/2007) với
mức án 2 năm tù treo và 3 năm thử thách.
- Cô Lê
Thị Lệ Hằng, thư kư đảng
Thăng Tiến Việt Nam, (bị bắt giữ
ngày 19/2/2007) với mức án 18 tháng tù treo và 2 năm thử
thách.

Ngày 3/5/2007 tại Đồng
Tháp, nhà cầm quyền Việt Nam đă đưa
ra toà xét xử và kết án các tín đồ Phật Giáo
Hoà Hảo Thuần Tuư:
- Ông Nguyễn
Văn Thơ, Hội Trưởng Giáo Hội PGHH
TT tại tỉnh Đồng Tháp, (bị bắt
ngày 02/10/2006) với mức án 6
năm tù giam.
- Bà Dương
Thị Tṛn, Hội Trưởng Hội Đoàn Phụ
Nữ Từ Thiện PGHH tỉnh Đồng Tháp (vợ
ông Nguyễn Văn Thơ, bị bắt ngày 02/10/2006) với
mức án 4 năm tù giam.
- Ông Lê
Văn Sóc, Phó Hội Trưởng Giáo Hội PGHH
TT tỉnh Vĩnh Long, (bị bắt ngày 04/11/2006) với
mức án 6 năm tù giam.
- Anh Nguyễn
Văn Thuỳ (tự Tam), Tổng Vụ Thanh Niên
PGHH TT tỉnh Vĩnh Long, (bị bắt ngày 22/04/2006)
với mức án 5 năm tù giam.

Ngày 10/5/2007 tại Sài G̣n,
nhà cầm quyền Việt Nam đă đưa ra toà xét
xử và kết án các thành viên của Đảng Dân Chủ
Nhân Dân:
- Bác sỹ
Lê Nguyên Sang, thành viên đảng Dân Chủ
Nhân Dân, (bị bắt ngày 14/8/2006) với mức án
5 năm tù ở và 2 năm quản chế.
- Luật
sư Nguyễn Bắc Truyển, giám đốc Công
ty Việt Thịnh Phú,
thành viên đảng Dân Chủ
Nhân Dân, (bị bắt ngày 14/8/2006) với mức
án 4 năm tù ở và 2 năm quản chế.
- Kư giả
Huỳnh Nguyên Đạo, giám đốc Công ty
Liên Hiệp Huỳnh, thành viên đảng Dân
Chủ Nhân Dân, (bị bắt ngày 14/8/2006) với mức
án 3 năm tù ở và 2 năm quản chế.

Ngày 11/5/2007 tại Hà Nội,
nhà cầm quyền Việt Nam đă đưa ra toà xét
xử và kết án:
- Luật
sư Nguyễn Văn Đài, trưởng văn
pḥng Luật sư Thiên Ân, người sáng lập
và cố vấn Uỷ Ban Nhân Quyền Việt Nam, biên
tập viên Tập san Tự Do Dân Chủ, (bị
bắt ngày 6/3/2007) với mức án 5 năm tù ở và
4 năm quản chế.
- Luật
sư Lê Thị Công Nhân, phát ngôn nhân đảng
Thăng Tiến Việt Nam, thành viên sáng lập và cố
vấn Ủy Ban Nhân Quyền Việt Nam (bị bắt
ngày 6/3/2007) với mức án 4 năm tù ở và 3 năm
quản chế.
·
Ngày 15/5/2007 tại Sài G̣n,
nhà cầm quyền Việt Nam đă đưa ra toà xét
xử và kết án:
- Luật
sư Trần Quốc Hiền, giám đốc
Công ty tư vấn luật Sài G̣n, phát ngôn nhân Hiệp
Hội Đoàn Kết Công-Nông Việt Nam (bị
bắt ngày 12/1/2007) với mức án 5 năm tù ở và
2 năm quản chế.
Nhiều
người bất đồng chính kiến khác đă
bị bắt giữ có thể sẽ bị đem ra
xét xử phi pháp trong thời gian tới như
Trương Quốc Huy, luật sư Lê Quốc Quân,
luật sư Nguyễn Thị Thuỳ Trang, nhà văn
Trần Khải Thanh Thuỷ, dân oan Hồ Thị Bích
Khương…Tất cả những người bất
đồng chính kiến, tranh đấu dân chủ nhân
quyền một cách ôn hoà nói trên đều bị nhà cầm
quyền Việt nam qui chụp cho vi phạm Điều
88 Luật H́nh Sự VN với tội danh "Tuyên truyền
chống nhà nước CHXHCN Việt Nam" – trong khi
điều luật này vi phạm nội dung các Điều
50, 53, 69 về "Quyền và các nghĩa vụ cơ
bản công dân" và Điều 146 về "Hiệu
lực pháp lư" của chính Hiến Pháp 1992 do nhà cầm
quyền Việt Nam ban hành. Nó cũng đi ngược
lại tinh thần và nội dung Tuyên Ngôn Quốc Tế
Về Nhân Quyền (1948) và Công Ước Quốc Tế
Về Các Quyền Dân Sự và Chính Trị (1966), mà Việt
Nam đă kư kết, phải tuân thủ và thi hành.
Điều
88 Luật H́nh Sự VN này do nhà cầm quyền Việt
Nam đă cố t́nh đặt ra, rơ ràng mục đích
không ǵ khác hơn là chỉ nhằm bịt miệng,
tước đoạt quyền tự do phát biểu ư
kiến, tư tưởng của người dân; tạo
cớ trù dập, đàn áp những người bất
đồng chính kiến.
Ủy ban
Nhân quyền Việt Nam lên án những vi phạm nhân quyền,
lên án hành vi trấn áp, bắt bớ, bỏ tù những
người bất đồng chính kiến, tranh đấu
dân chủ nhân quyền tại Việt Nam và yêu cầu
nhà cầm quyền Việt Nam phải trả tự do
vô điều kiện cho các công dân hoàn toàn vô tội nói
trên. Và chấm dứt ngay những phiên toà phi pháp, phi
chính nghĩa, những hành động đàn áp tương tự trong tương
lai.
Uỷ ban
Nhân quyền Việt Nam kêu gọi mỗi một
người dân Việt Nam trong cũng như ngoài
nước hăy là một hạt nhân bảo vệ nhân
quyền v́ chính tương lai của dân tộc Việt
Nam để có thể sánh vai được với
các quốc gia văn minh tiến bộ trên thế giới.
Ủy ban
Nhân quyền Việt Nam đồng thời kêu gọi
cộng đồng quốc tế lên án những vi phạm
nhân quyền của chính quyền cộng sản Việt
Nam và lên tiếng bảo vệ cho những người
vận động dân chủ
, hoạt
động tôn giáo và nhân quyền một cách ôn hoà, bất
bạo động ở Việt Nam.

The Committee for Human Rights in Vietnam (CHRV) protests the
trials of political dissidents and human rights advocates by the
Vietnamese communist government.
Since the
beginning of 2007 the communist government has launched a brutal crackdowns on many community organizations
and groups in Vietnam
in order to quell the aspirations of Vietnamese people for freedom and
democracy. After a brief interruption of activities during which many of
its members were harassed, arrested, persecuted, or harshly sentenced,
the CHRV has resumed its reporting on the severe human rights violations
of the Vietnamese communist government in recent months.
On March 30,
2007, the Hue
City authorities
put on trial and sentenced Catholic Father Nguyen Van Ly and various leaders
of the Vietnam Progression Party.
-
Father Nguyen Van Ly, a founder and leader of Bloc 8406 (arrested on
February 18, 2007), was sentenced to eight years of imprisonment to be
followed by five years of house arrest.
-
Mr. Nguyen Phong, chief founder of the Vietnam Progression Party
(arrested on February 17, 2007), was sentenced to six years of
imprisonment to be followed by three years of house arrest.
-
Mr. Nguyen Binh Thanh, cofounder of the Vietnam Progression Party (arrested
on February 17, 2007), was sentenced to five years of imprisonment to be
followed by two years of house arrest.
-
Ms. Hoang Thi Anh Dao, secretary general of the Vietnam Progression Party
(arrested on February 19, 2007), was sentenced to two years of " tù treo"(literally
"suspended sentence"; comparative to
"non-confinement") to be completed by three years of
probation.
-
Ms. Le Thi Le Hang, secretary of the Vietnam Progression Party (arrested
on February 19, 2007), was sentenced to 18 months of "
tù treo"(literally "suspended sentence";
comparative to "non-confinement") to be followed by two
years of probation.
On May 3,
2007, the Dong
Thap Province
authorities put on trial and sentenced followers of the Hao Hao Buddhist
Indigenous Church of Vietnam (HHBICV)
-
Mr. Nguyen Van Tho, chairman of the Dong Thap Province
Administrative Committee, HHBICV (arrested on October 2, 2006), was
sentenced to four years of imprisonment.
-
Mrs. Duong Thi Tron, chair of the Dong Thap Province Women's
Committee for Charitable Work, HHBICV (wife of Chairman Tho; arrested on
October 2, 2006), was sentenced to six years of imprisonment.
-
Mr. Le Van Soc, chairman of the Vinh Long Province Administrative
Committee, HHBICV (arrested on November 4, 2006), was sentenced to six
years of imprisonment.
-
Mr. Nguyen Van Thuy (aka Tam), youth affairs head of HHBCV's Vinh
Long Province Administrative Committee (arrested on April 22, 2006), was
sentenced to five years of imprisonment.
On May 10, 2007 the Saigon (Ho
Chi Minh City) authorities put on trial and
sentenced members of the People's Democratic Party (PDP).

Le Nguyen Sang, MD, a member of the PDP (arrested August 14,
2006), was sentenced to five years of imprisonment to be followed by two
years of house arrest.
-
Attorney Nguyen Bac Truyen, director of Viet Thinh Phu Co. and a
member of the PDP (arrested August 14, 2006), was sentenced to four years
of imprisonment to be followed by two years of house arrest.
-
Journalist Huynh Nguyen Dao, director of Lien Hiep Huynh Co. and a
member of the PDP (arrested August 14, 2006), was sentenced to three
years of imprisonment to be followed by two years of house arrest.
On May 11, 2007, the Ha Noi Capital authorities put on trial and
sentenced two other dissidents:
-
Attorney
Nguyen Van Dai, head of the Thien An law office
and a founder and counsel of the CHRV, a contributing editor to the Tu Do
(Freedom) magazine (arrested on March 6, 2007), was sentenced to five
years of imprisonment to be followed by four years of house arrest.
-
Attorney
Le Thi Cong Nhan, spokesperson of the Vietnam Progression Party and a
founder and counsel of the CHRVN (arrested on March 6, 2007), was
sentenced to four years of imprisonment to be completed by three years of
house arrest.
On May 15, 2007, the Ho Chi Minh City (Saigon) authorities put on
trial and sentenced attorney Tran Quoc Hien, director of the Saigon Law
Consultation office and spokesperson of the United Farmers anf Workers
Association (arrested on January 12, 2007), to five years of imprisonment
to be followed by two years of house arrest.
Other political dissidents (currently in detention), namely Truong
Quoc Huy, attorney Le Quoc Quan, attorney Nguyen Thi Thuy Trang, writer
Tran Khai Thanh Thuy, Ho Thi Bich Khuong (a victim of injustice) may be
unduly tried in the near future. Despite having peacefully advocated
democracy and human rights, they all were persecuted by the Vietnamese
communist government under Article 88 of the Criminal Code for
"having disseminated propaganda against the Socialist Republic of
Vietnam". This article contravenes Articles 50, 53 and 69 relating
to "[Vietnamese] Citizens' Basic Rights and Responsibilities, as
well as Article 146 regarding "Legal Effects" of the Vietnamese
Constitution of 1992. Article 88 runs counter to the intent and contents
of the Universal Declaration of Human Rights (1948) and the International
Covenant of Civil and Political Rights (1966) --the two documents Vietnam
has the responsibility to uphold and implement as a signatory.
The CHRV hereby condemns all the above-mentioned
human rights violations --whether harassment, intimidation, arrest, or
imprisonment –against the political dissidents and human rights advocates
in Vietnam.
It urges the Vietnamese communist government to immediately release the
innocent citizens above, as well as cease and desist
similar unjust, kangaroo-court-trials and acts of persecution in the
future.
The CHRV calls upon each and every Vietnamese, both in and outside
of the country, to become a seed of human rights protection for the
benefits of tomorrow's Vietnam, which is to rise shoulder to shoulder
with other civilized countries the world over.
The CHRV also calls upon the international community to condemn
the Vietnamese communist government's human rights violations, and voice
its support for non-violent advocates for religious freedom, human rights
and democracy in Vietnam.

Le Comité pour les Droits de l'Homme au
Vietnam proteste contre la condamnation illégale portée par les autorités
vietnamiennes à l'encontre des opposants politiques qui luttent pour la
démocratie et les droits de l'homme
Depuis le début de l'année
2007, une campagne de répression d'envergure a été lancée par le régime
communiste contre de nombreuses organisations et groupes d'opposants afin
d'étouffer dans l'œuf les aspirations du peuple vietnamien à la liberté
et à la démocratie. Après une brève interruption des activités pendant
laquelle plusieurs de ses membres ont été harcelés, arrêtés, persécutés
ou lourdement condamnés, le Comité pour les Droits de l'Homme au Vietnam
(CDHV) reprend la publication de ses rapports sur la situation des droits
de l'homme et leurs violations au cours des derniers mois par le
gouvernement communiste vietnamien.
·
Le 30 mars 2007 , les autorités de la ville de Huê ont
mis en accusation et condamné le P. Nguyen Van Ly et plusieurs membres du
Parti du Progrès du Vietnam (PPV) :
- P Nguyen Van ly,
fondateur et leader du mouvement appelé 'Bloc 8406' (arrêté le
18.02.2007), a été condamné à huit ans d'emprisonnement et cinq ans de
résidence surveillée.
- M. Nguyen Phong,
fondateur du PPV (arrêté le 17.02.2007) : six ans d'emprisonnement plus
trois ans de résidence surveillée.
- M. Nguyen Binh
Thanh, cofondateur du PPV (arrêté le 19.02.2007) : cinq ans
d'empri-sonnement plus deux ans de résidence surveillée.
- Melle Hoang Thi Anh
Dao, secrétaire générale du PPV (arrêtée le 19.2.2007) : deux ans de
prison avec sursis suivi d'une période probatoire de trois ans.
- Melle Le Thi Le Hang, secrétaire du
PPV (arrêtée le 19.02.2007) : 18 mois de prison avec sursis suivi d'une
période probatoire de deux ans.
·
Le 3 mai
2007 , les autorités de la
province de Dong Thap ont mis en accusation et condamné des adeptes de
l'Eglise bouddhique authentique Hoa Hao (EBAHH) :
- M. Nguyen Van
Tho, président du comité administratif de l'EBAHH de la province de Dong
Thap (arrêté le 2.10.2006) : quatre ans d'emprisonnement.
- Mme Duong Thi
Tron, épouse de M Tho, présidente du comité d'oeuvres charitables de
l'EBAHH de la province de Dong Thap (arrêtée le même jour que son mari) :
six ans d'emprisonnement.
- M. Le Van
Soc, président du comité administratif de l'EBAHH de la province de Vinh
Long (arrêté le 4 novembre 2006) : six ans d'emprisonnement.
- M. Nguyen Van
Thuy (alias Tam), chef du comité de la Jeunesse de l'EBAHH de la province
de Vinh Long (arrêté le 22 avril 2006) : cinq ans d'emprisonnement.

Le
10 mai
2007,
les autorités de Ho Chi Minh Ville (Saigon) ont mis en accusation et
condamné des membres du Parti démocratique du Peuple (PDP) :
- M. Nguyen
Sang, médecin, membre du PDP (arrêté le 14.8.2006) : cinq ans
d'emprison-nement plus deux ans de résidence surveillée.
- M. Nguyen Bac
Truyen, avocat, directeur de l'entreprise Viet Thinh Phu, membre du PDP
(arrêté le 14.8.2006) : quatre ans d'emprisonnement plus deux ans de
résidence surveillée.
- M. Huynh
Nguyen Dao, journaliste, directeur de l'entreprise Lien Hiep Huynh,
membre du PDP (arrêté le 14.8.2006) : trois ans d'emprisonnement plus
deux ans de résidence surveillée.
·
Le 11
mai 2007, les
autorités de Hanoi ont mis en accusation et condamné deux autres
dissidents :
- M. Nguyen Van Dai,
avocat, directeur du cabinet Thien An et conseiller du CDHV,
collaborateur du magazine Tu Do (Liberté), arrêté le 6 mars 2007 : cinq
ans d'emprisonnement plus quatre ans de résidence surveillée.
- Melle Le Thi Cong Nhan,
avocate, porte-parole du PPV, membre fondateur et conseillère CDHV
(arrêtée le 6 mars 2007) : quatre ans d'emprisonnement plus trois ans de
résidence surveillée.
·
Le 15 mai 2007, les
autorités de Ho Chi Minh City (Saigon)
ont mis en accusation et condamné M.
Tran Quoc Hien, avocat, directeur du cabinet
de consultation juridique de Saigon et porte-parole de l'Union des
Fermiers et des Travailleurs (arrêté le 12 janvier 2007) à cinq ans
d'emprisơnement plus deux ans de résidence surveillée.
De
nombreux autres dissidents actuellement en détention, comme M. Truong
Quoc Huy, les avocats Le Quoc Quan et Nguyen Thi Thuy Trang, l'écrivain
Tran Khai Thanh Thuy, Mme Ho Thi Bich Khuong (victime d'une injustice),
pourraient être illégalement jugés dans un avenir proche. Bien qu'ils
n'aient agi que de façon pacifique au nom de la démocratie et des droits
de l'homme, ils ont du tous subir les persécutions
du gouvernement communiste en vertu de l'Article 88 du Code pénal sur la
"diffusion de la propagande contre la République socialiste du
Vietnam". Rappelons que cet Article viole de façon flagrante les
Articles 50, 53 et 69 relatifs aux "Droits et Devoirs fondamentaux
des Citoyens [vietnamiens]", aussi bien que l'Article 146 sur les
"Effets juridiques" de la Constitution vietnamienne de 1992. De
plus l'Article 88 contrevient tant à l'esprit qu'à la lettre de la
Déclaration universelle des Droits de l'Homme de 1948 et au Traité
international sur les Droits civiques et politiques de 1966 – deux
documents que le Vietnam a le devoir de respecter et de mettre en œuvre
en tant que signataire
Pour
les raisons citées ci-dessus, le Comité pour les Droits de l'Homme au
Vietnam condamne solennellement tous les actes de harcèlement,
d'intimidation, d'arrestation ou d'emprisonnement à l'encontre des
opposants politiques et des militants des droits de l'homme au Vietnam.
Le CDHV demande au gouvernement communiste vietnamien de libérer
immédiatement et sans condition les citoyens innocents susmentionnés et
de cesser tout procès inique et tout acte de persécution contre ses
citoyens dans le futur.
Le CDHV
invite tous les Vietnamiens dans le pays comme à l'étranger, à former une
chaîne de solidarité pour protéger les droits de l'homme au Vietnam, afin
d'aider ce pays à se hausser au niveau des nations civilisées du monde.
Le CHRV
en appelle à la communauté internationale pour condamner les violations
des droits de l'homme perpétrées par le gouvernement communiste
vietnamien, et pour affirmer son soutien à ceux qui continuent de militer
de façon non violente pour la liberté religieuse, les droits de l'homme
et la démocratie au Vietnam.
