Mọi người
Việt Nam và mọi người thiện chí trên thế
giới đều hy vọng rằng: Sau khi Việt
Nam vào WTO, đạt được quy chế PNTR,
được lấy tên ra khỏi danh sách CPC,…Nghĩa
là sau khi Việt Nam gia nhập vào cộng đồng
văn minh của thế giới, vào "sân chơi quốc
tế",… th́ nhà cầm quyền cộng sản Việt
Nam sẽ tôn trọng luật quốc tế, luật của
WTO và nhất là tôn trọng bản Hiến pháp do chính họ
lập ra,… Thực tế xảy ra trong những tuần
lễ gần đây – trước và sau tết cổ
truyền của dân tộc Việt Nam
đă khiến cho tất cả mọi người
đều thất vọng. Họ đă chà đạp
lên ṭan bộ những luật ấy, lên bản Hiến
pháp ấy:
§ Trước tết,
họ đă bắt bớ một cách hoàn toàn vô pháp luật
Luật sư Nguyễn Văn Đài, Luật sư Lê
Thị Công Nhân, Kỹ sư Bạch Ngọc
Dương, chỉ v́ những người này phổ
biến cho một vài người bạn những kiến
thức về nhân quyền. Việc phổ biến này
chẳng những không hề vi phạm pháp luật mà
c̣n là điều rất tốt, nên làm và cần phải
làm trong bất cứ quốc gia nào.
§ Tại Huế,
miền Trung Việt Nam, ngay những ngày đầu
năm âm lịch 2007, là những ngày linh thiêng nhất
trong năm, họ đă:
- Bao vây Ṭa Giám Mục Huế, khám xét
pḥng Linh mục Nguyễn Văn Lư, phá tủ, tịch
thu nhiều máy vi tính, điện thoại di động
của ông và quản chế ông tại gia, biến chính
căn pḥng ông ở thành nhà tù.
- Bắt anh Nguyễn Phong, anh Nguyễn
B́nh Thành, cô Lê Thị Lệ Hằng, cô Hoàng Thị Anh
Đào, lục soát nhà, tịch thu phương tiện
làm việc, bắt thẩm vấn, giam giữ trong những
ngày Tết Nguyên Đán. Đặc biệt họ dùng
áp lực ép buộc anh Nguyễn Phong phải cam kết
những điều mà trong điều kiện b́nh
thường không bao giờ anh chịu làm như: giải
tán đảng Thăng Tiến và liên đảng Lạc
Hồng, rút tên ra khỏi khối 8406, chấm dứt
quan hệ với Linh mục Nguyễn Văn Lư và các
nhà đấu tranh dân chủ khác, ngưng hoạt động
đấu tranh cho dân chủ,…
Liên Minh Dân Chủ
Nhân Quyền Việt Nam cho rằng:
1) Tất
cả những hoạt động của các nhà dân chủ
nói trên đều nằm trong khuôn khổ hiến pháp
Việt Nam
và luật quốc tế. Đó là những hành động
thể hiện những quyền tự do căn bản
mà hiến pháp Việt Nam và luật quốc
tế công nhận. Hành động đàn áp của nhà
cầm quyền CSVN trong những ngày vừa qua là hoàn
toàn sai trái. Nó chẳng những vi phạm luật pháp
quốc tế, mà c̣n chà đạp trắng trợn lên
chính bản Hiến pháp do họ lập ra.
2) Rơ ràng, việc nhà cầm quyền
cộng sản Việt Nam ra lệnh cho công an Việt
Nam hành động phi pháp như vậy chỉ với
một mục đích duy nhất là để bảo vệ
và duy tŕ vô thời hạn, bằng mọi giá chế
độ độc tài toàn trị, đặc quyền,
đặc lợi của họ mà thôi. Chính thể này
ḥan ṭan không phải của dân, do dân và v́ dân,… như họ vẫn thường rêu
rao một cách không biết xấu hổ. Chính thể
này, ṭan dân tộc đă buộc ḷng phải chấp nhận
suốt gần 62 năm qua (2/9/1945 – 2/2007), kể từ
khi họ cướp được chính quyền, với
bộ máy chuyên chính vô sản tàn ác được thiết
lập, mà chức năng thứ nhất của nó theo
Lênin là: Bạo lực và trấn áp!
3) Việc anh Nguyễn Phong bị
nhà cầm quyền cộng sản Việt Nam ép buộc
phải viết giấy công bố giải tán đảng
Thăng Tiến và liên đảng Lạc Hồng, rút
tên ra khỏi khối 8406, chấm dứt quan hệ với
Linh mục Nguyễn Văn Lư và các nhà đấu tranh
dân chủ khác, ngưng các hoạt động đấu
tranh cho tự do, dân chủ,… trong hoàn cảnh mất tự
do như trên là hoàn toàn không có giá trị pháp lư. Một
công bố như thế chỉ có giá trị pháp lư khi
được thực hiện trong điều kiện
b́nh thường, khi đương sự làm điều
đó một cách tự do, chứ
không phải bị áp lực như đă xảy ra.
Trước
t́nh cảnh nhà cầm quyền cộng sản Việt
Nam
gia tăng đàn áp một cách phi pháp các nhà đấu
tranh dân chủ như trên. Liên Minh Dân Chủ Nhân Quyền
Việt Nam thiết
tha kêu gọi các cá nhân và các cơ quan nói trên hăy hành
động một cách thiết thực, nhanh chóng và cụ
thể, để phản đối nhà cầm quyền
cộng sản Việt Nam. Buộc họ phải
chấm dứt ngay những hành động phản dân
chủ, phản văn minh; phản lại luật quốc
tế về nhân quyền và phản lại chính bản
Hiến pháp do họ lập ra.
Một số
hành động cụ thể xin được đề
nghị:
1) Tổ chức và tham gia tích cực
những cuộc biểu t́nh phản đối nhà cầm
quyền CSVN về những hành động vi phạm
nhân quyền của họ trên đây.
2) Lên tiếng phản đối
trên các phương tiện thông tin đại chúng (báo
chí, truyền thanh, truyền h́nh,…) và
phát rộng răi về Việt Nam.
3) Gọi điện thoại, email,
fax,… đến các cơ quan chức
năng của nhà cầm quyền cộng sản Việt
Nam
để biểu lộ sự phản đối.
Đồng thời, ra Nghị Quyết yêu cầu họ
phải chấm dứt ngay và chấm dứt một
cách vô điều kiện những hành động man rợ
trên.
Nhân dịp
này, Liên Minh Dân Chủ Nhân Quyền Việt Nam kêu gọi
các công an Việt Nam - Những người đă,
đang và sẽ tiếp tục làm nhiệm vụ theo
dơi, khủng bố, đàn áp những người dân
oan khiếu kiện, những người đang đấu
tranh cho tự do dân chủ cho Việt Nam, rằng:
Con đường
dân chủ hóa thực sự đất nước, với
mục tiêu của nó là tiến hành một cuộc thay
thế triệt để, từ thể chế độ
chính trị độc tài, độc đảng, ṭan
trị, phản dân tộc và phản dân chủ hiện
nay, sang thể chế chính trị đa nguyên, đa
đảng tiến bộ trong tương lai là không thể
đảo ngược! Vấn đề chỉ c̣n là
thời gian và thời gian ấy cũng chỉ tính bằng
năm tháng mà thôi. Các vị hăy biết sợ đ̣n trừng
phạt của công lư khi dân tộc này chuyển ḿnh! Hoặc
trước mắt, khi mà tội ác của quư vị
chưa bị trừng phạt th́ cũng hăy biết sợ
sự trừng phạt của trời phật thần
linh! Nhân dân rất độ lượng, nhưng nhân
dân cũng sẽ nhất định không khoan nhượng
nếu như các vị c̣n tiếp tục gây tội
ác! Những Hồ sơ lưu trữ, những nhà
đấu tranh dân chủ, những người dân oan
và cả những người đồng đội
có lương tâm của quư vị,…
sẽ trực tiếp tố cáo tội ác của quư vị
trong tương lai. Tội ác phải bị trừng
phạt! Chúng tôi rất mong quư vị hăy tỉnh táo nghĩ
đến bản thân và gia đ́nh ḿnh, mà sớm sám hối
để đứng về phía Tổ quốc và Dân tộc!

A CALL TO ACTION
Re: To protest the Communist
government persecution of the democracy dissidents on the occasion of the
Lunar New Year of the Pig, 2007

Vietnamese and good-faith
people of the world over expect that after
Vietnam’s entry into the WTO and received the PNTR, as well as had its
name removed from the list of Countries of Particular Concern (CPC), that
is, after Vietnam has joined the world civil societies and accepted the
international standard of a leveled playing field, that it would respect
international law, requirements of the WTO, and particularly accepting
its very own constitution that it has drafted.
In reality, events and
incidents that have transpired around the time of the traditional
Vietnamese Lunar New Year have greatly disappointed everyone. The
government of Vietnam
has trampled on the all the laws as well as its own constitution.
First, thumping its nose on
the law, they have arrested lawyer Nguyen van Dai, lawyer Le thi Cong
Nhan, engineer Bach Ngoc Duong, just because these individuals have
passed on to their friends the
human rights information. Not only did the dissemination of this
information violate any law, it is a very commendable act that should be
valued and respected in any nation.
In Hue,
central Vietnam,
at the beginning of the 2007 lunar new year holidays, normally a very
sacred time of the year, they communist authority has:
-
Laid
siege to the Hue
bishop sanctuary, ransacked father Nguyen van Ly’s room, broke into his armoire,
confiscated many computers, mobile phones and held him under house
arrest, transformed his room into a prison cell.
-
Arrested
Messrs. Nguyen Phong, Nguyen Binh Thanh, Misses Le thi Le Hang, Hoang thi
Anh Dao, searched their houses, took over their working equipment,
interrogated, detained them during the lunar new
year. And particularly under duress, they forced Mr. Phong Nguyen to
commit to things that under normal conditions he would not submit to,
such as disbanding The Progression Party, withdrawing his name from the
8406 Bloc, discontinuing his relationship with father Nguyen van Ly and
other democracy activists…
The Alliance for Democracy and Human Rights
considers:
1)
All the
activities of the democracy activists are carried out in the framework of
the Vietnamese constitution and international law. Those activities
represent the basic freedom that the Vietnamese constitution and
international law recognize. The repression tactics that the Vietnamese
communist authority employed over the last several days are completely
unlawful. Not only did they violate international law, they have
completely trampled on the very constitution that communist Vietnamese
government, itself, had drafted.
2)
Clearly,
the Vietnamese communist government’s order to the Security Police
sanctioning their illegal activities by all means possible is for the
expressed purpose of defending and perpetuating indefinitely their rule,
their power and their privilege on the country. This government is
not of the people, for the
people, or by the people… as they have propagated shamelessly. The
whole people of Vietnam
have endured his regime for almost 62 years (September 2, 1945 to
February 2007) ever since their usurpation of power, establishing their
ruthless dictatorial rule according to Lenin’s motto: Violence and persecution!
3) The fact that Mr.
Nguyen Phong was forced to sign a renunciation, disbanding the
Progression Party and the Lac Hong Alliance, withdrawing from the 8406
Bloc, terminating the relationship with father Nguyen van Ly and other
democracy activists, stopping all his democracy and human rights
activities… under such duress renders his action with little legal merit.
Such declaration would have more validity under the law only when it was
carried out by his own free will and not forced
as had happened.
In the face of the Vietnamese communist authority
increasing unlawful repression against
the above named activists, the alliance for Democracy and Human Rights earnestly calls out to
individuals and organizations mentioned above and asks that we all resolutely, immediately and
concretely to protest against the Vietnamese
government actions. Pressure them to cease and desist at once the undemocratic, uncivilized, unlawful and anti
human right measures that violate the
very Vietnamese constitution.
We would like to propose the
following:
1) Organize and
participate in demonstration to denounce Vietnamese communist authority
for their unconstitutional acts mentioned above.
2) To voice our
opposition in the press and international media such as radio,
television, internet, newspapers and to broadcast widely back to Vietnam
3) To telephone,
email, fax the various Vietnamese agencies to express our opposition.
Also, sign petitions asking them to cease and desist unconditionally
their barbaric acts.
On this occasion, The
Allliance for Democracy and Human Rights would like to remind the
Security Police, those that have and will carry out their functions of
stalking, terrorizing, repressing innocent citizens who are petitioning
for a redress of grievances, the democracy and human rights activists,
that:
The road to true
democratization of our country is to forward a complete transformation,
from a dictatorial political regime, one party, one totalitarian rule -
that is against the people - to a pluralistic, multi party, progressive
political system for the future which is irreversible.
The issue is time and that
this time is measured in months and years only.
Please be fearful of the
punishment of justice when our populace start to rumble. During the
present time, when your crime goes unpunished, please do fear the holy
spirit of our forebears and Buddha and God!
The people are very
compassionate, but they will resolutely not forgive or condone if you
persist in committing your crime! Those dossiers that are filed against
the democracy activists, the citizens who have been wronged and cheated,
as well as the records of your rank and file who still possess
conscience… these will be used to judge you in the future. Your crime
will be punished! We sincerely hope that you will be wise and sober
enough to think about your family and yourselves to quickly stand by the
ranks of the nation and the people!

A/S: Protester contre le régime communiste vietnamien qui réprime les démocrates le jour de
l'an Dinh Hoi 2007

Gouvernements des pays démocratiques,
- Aux Ambassades et Consulats
étrangers au Vietnam,

Aux Organisations vietnamiennes et internationales de défense des Droits
de l'homme,

Aux Peuples et aux opinions vietnamiens et internationaux

Aux Organes médiatiques vietnamiens et internationaux,
Tous les Vietnamiens et les
personnes de bonne volonté du monde espéraient qu’après son entrée dans
le WTO, l’obtention du statut de PNTR et sa radiation de la liste
CPC,…c'est-à-dire après son adhésion à la communauté mondiale civilisée,
au "terrain de jeu international" le régime vietnamien
respecteraient le droit international, les règlements du WTO et surtout
sa propre constitution…
La réalité qui s'est déroulée
les dernières semaines – juste avant et après le Têt, nouvel an traditionnel du peuple vietnamien – a jeté tout le
monde dans le désespoir total. Les communistes vietnamiens ont piétiné
tous ces lois et règles et cette constitution:
- En premier lieu ils ont arrêté de façon
absolument illégale les avocats Nguyen Van Dai et LeThi Cong Nhan,
l'ingénieur Bach Ngoc Duong simplement parce que ceux-ci transmettaient à
des amis quelques connaissances sur les droits de l'homme. Cet
enseignement non seulement ne constitue pas un délit mais encore est une action
louable et même indispensable à tout pays
- A Hué, centre Vietnam, aux premiers jours
de l'année lunaire 2007, le Têt, la période la plus sacrée, ils ont:
- encerclé
l'archevêché de Hué, fouillé le bureau du père Nguyen Van Ly, défoncé
l'armoire et confisqué des ordinateurs, des téléphones portables lui
appartenant et l'ont consigné sur place, transformant son bureau et
domicile en lieu de détention;
- arrêté MM.
Nguyen Phong, Nguyen Binh Thanh, MMes Le Thi Le Hang et Hoang Thi Anh Dao, fouillé leurs
domiciles, confisqué leurs outils de travail, soumis ceux-ci à des
interrogatoires, et les ont détenus pendant la période du Têt. En
particulier, sous la pression, ils ont contraint M. Nguyen Phong à des
engagements que dans des conditions normales il n'aurait jamais acceptés,
comme: dissoudre le Parti du Progrès et la Fédération de Partis Lac Hong,
se retirer du Bloc 8406, rompre les contacts avec le père Nguyen Van Ly
et les autres combattants pour la démocratie, cesser toute activité
démocratique…
L'Alliance
vietnamienne pour la Démocratie et les Droits de l'homme considère
que:
1) Toutes les activités de tous les démocrates
précités sont en conformité avec la constitution du Vietnam
et le droit international. Ce sont des manifestations des libertés
fondamentales reconnues par ces institutions. Les récents actes de
répression du pouvoir vietnamien étaient totalement fautifs. Non
seulement ils étaient en infraction du droit international, mais encore
ils piétinaient la constitution créée par ce même régime.
2) Il est
évident que le pouvoir vietnamien, en ordonnant à sa police d'agir ainsi
de façon illégale, vise le seul but de protéger et maintenir indéfiniment
et à tout prix le régime dictatorial et totalitaire, ainsi que les
avantages et intérêts personnels spéciaux. Ce régime n'est en aucune
façon du peuple, par le peuple ni pour le peuple… comme il s'est toujours
vanté effrontément. Notre nation entière a été
contrainte de l'accepter toutes ces 62 dernières années (2/9/45 –
2/2007), depuis que les communistes s'étaient emparés du pouvoir, avec
leur appareil de dictature prolétarienne dont la première mission selon
Lénine était la répression par la violence.
3) Ce qu'a
fait M. Nguyen Phong sous contrainte, c'est-à-dire s'engager à dissoudre
le Parti du Progrès et la Fédération de Partis Lac Hong, se retirer du
Bloc 8406, rompre les contacts avec le père Nguyen Van Ly et les autres
combattants pour la démocratie, cesser toute activité démocratique…
n'avait aucune valeur juridique, car son acte n'était pas accompli dans
des conditions normales et en toute liberté.
Pour faire face à cette situation de répression
illégale, L'Alliance vietnamienne
pour la Démocratie et les Droits de l'homme prie instamment les
personnes et organismes cités en début de cet appel d'agir effectivement,
concrètement et
rapidement pour protester contre ce régime vietnamien,
l'obligeant à cesser immédiatement ses actes antidémocratiques,
contraires à la civilisation et au droit international et à sa propre
constitution. Nous nous permettons de leur proposer de:
1) Organiser et participer à des manifestations de
protestation,
2) S'exprimer dans ce sens sur les divers organes
médiatiques et les diffuser largement à destination du Vietnam,
3) Téléphoner, envoyer des emails, faxer aux
organismes gouvernementaux communistes vietnamiens et leur manifester
votre opposition aux actes en question. En même temps publier des
résolutions leur enjoignant de cesser sans délai et sans condition de
tels actes de barbarie.
Saisissant cette occasion, L'Alliance vietnamienne pour la Démocratie et les Droits de
l'homme rappelle aux membres de la police vietnamienne, ceux qui sont
chargés à l'heure actuelle de filer, terroriser et réprimer les
combattants de la démocratie, que: la voie de la vraie démocratisation
avec un changement radical, le remplacement de l'actuelle dictature
politique, monopartite, totalitaire, antidémocratique et antipopulaire
par un futur régime pluraliste, multipartite, progressiste… est incontournable
et sans retour possible! Ce n'est plus qu'un problème de temps, et ceci
se compte en mois ou tout au plus en années. Vous avez intérêt à redouter
les sanctions de la justice au moment où ce peuple bougera! Pour l'heure,
vos méfaits ne sont pas encore punis, pensez au moins à la puissance des
Etres supérieurs, le Ciel ou autres Génies! Le peuple est indulgent, mais
il serait impitoyable si vous vous entêtiez et persistiez dans vos
méfaits! Les archives, les combattants de la démocratie, les victimes
d'injustices et vos compagnons d'armes doués de conscience… vous
accuseront directement dans l'avenir. Tout crime sera puni! Nous espérons
de tout cœur que vous réfléchirez et penserez à vous-mêmes et à vos
familles, pour vous repentir sincèrement et rejoindre rapidement les
rangs de la Patrie et de la Nation!

avez accordée à nos propos.
